This English translation is provided for convenience only. The Spanish version is the legally binding one and prevails in case of any discrepancy.

These Terms and Conditions (hereinafter, the “Terms”) govern the use of the digital memorial page service that Cempa provides through https://cempa.app. Please read them in full before creating your account or accepting a memorial page. The current version is available at all times, without the need to sign in, at https://cempa.app/terms.

The processing of your personal data is governed by a separate document, the Privacy Notice, available at https://cempa.app/privacy. Accepting these Terms does not amount to giving consent to the processing of personal data: where such consent is required, it will be requested from you separately.

Cempa does not offer the Service in online stores or on third-party portals. In the current channel, the Service is offered by the funeral homes partnered with Cempa at their own premises.

2. Definitions

  • Service: the Cempa platform for creating, managing and publishing memorial pages, including the website https://cempa.app, user accounts and the emails the platform sends.
  • Memorial page or Page: the website dedicated to the memory of a deceased person.
  • Deceased Person: the person to whose memory a Page is dedicated.
  • Account: personal access to the Service protected by credentials.
  • User: an individual of legal age who holds an Account to manage one or more Pages on behalf of their family; usually, the family member who contracted the Service with a Funeral Home.
  • Page Holder: the User who manages a Page in accordance with section 7. Not to be confused with the “titular” (data subject) of personal data referred to in the Privacy Notice.
  • Funeral Home: the funeral agency partnered with Cempa that offers the Service to families, as well as the staff of that agency who use the Service with a Funeral Home Account.
  • Visitor: any person who views a public Page, whether or not they hold an Account.
  • Content: the texts, photographs, data, links and other materials added to a Page.
  • Immediate Family Member: with respect to the Deceased Person, their spouse, common-law partner (concubina or concubinario), daughters and sons, mother and father, and sisters and brothers.

3. Acceptance of the Terms and record of acceptance

3.1. How they are accepted. To create an Account, whether with an email address and password, with a Google account or through the invitation link sent by the Funeral Home, you must tick the checkbox “I am of legal age and I accept the Terms and Conditions”, which is never pre-ticked. You cannot continue until the checkbox is ticked. The link to this document is displayed next to the checkbox.

3.2. What we record. Each time you accept these Terms, Cempa keeps an electronic record containing: your Account identifier; the version accepted (its full text and its digital fingerprint, or hash); the date and time; the IP address; your browser and device data (User-Agent), and the channel through which you accepted (email and password, Google or the Funeral Home’s invitation link). Acceptance by electronic means is valid under the Commercial Code (Código de Comercio).

3.3. How long we keep it. We keep the record of acceptance for at least ten years, the period established by the Commercial Code, even if you close your Account. We use it solely to evidence the terms under which the Service was provided and to handle clarification requests, complaints or requests from authorities. You may ask us at any time for a copy of the version you accepted and of your record.

3.4. Acceptance separate from the Privacy Notice. Acceptance of these Terms is collected through its own checkbox, separate from any consent to the processing of personal data. The simplified privacy notice is displayed in a separate block.

3.5. Funeral Home staff. Funeral Home staff who use the Service accept these Terms insofar as they relate to the use of the platform. The commercial terms between Cempa and each Funeral Home are set out in a separate agreement, which cannot reduce the rights that these Terms grant to Users and Visitors.

4. Registration, minimum age and use of the Account

4.1. Legal age. To hold an Account you must be 18 years of age or older, the age at which a person attains legal age under the Federal Civil Code (Código Civil Federal). You confirm this by ticking the checkbox in section 3.1. If we detect that an Account belongs to a minor, we will suspend it and, using the available contact details, seek an adult family member to manage the Page. The Page is not deleted for this reason.

4.2. Ways to register.

  • With an email address and password: we will send a confirmation code to your email and ask for your name.
  • With a Google account, when this option is available on the sign-in screen. The first time you sign in with Google, we email you a generated password so that you can also sign in with your email address; we recommend changing it after signing in.
  • With the invitation link you receive by email when a Funeral Home delivers a Page to you. The invitation is valid for 14 calendar days; if it expires, the Funeral Home can send you a new one.

4.3. Truthful information. You undertake to provide truthful information and to keep your email address up to date, because it is the means by which we notify you of everything related to your Page.

4.4. Personal Account. The Account is personal and non-transferable. You must keep your password confidential and notify us immediately at support@cempa.app if you suspect that someone else is using it. To change who manages a Page, the procedure in section 7.5 must be followed, not the lending of credentials.

4.5. Permitted use. The Service is used to honor and remember deceased persons. It is not permitted to: create Pages for persons who have not died; impersonate another person; attempt to access other people’s Accounts or private Pages; extract Content by automated means; interfere with the operation or security of the Service, or use it for unlawful purposes or for advertising purposes unrelated to the memory of the Deceased Person.

5. The Service

5.1. What a Page may contain. With the features available as of the date of this version, a Page may include:

  • the name, dates and places of birth and death, occupation, education and honors of the Deceased Person;
  • a main photograph;
  • a biography organized into text blocks with photographs and quote blocks;
  • an epitaph;
  • up to five external links, for example, to videos published on third-party platforms;
  • the location of the burial site on a map, with its address and directions;
  • decorative elements provided by Cempa, such as candles and ornaments;
  • a QR code that opens the Page, and
  • virtual candles that Visitors can light and that are displayed as a counter.

The supported image formats (JPEG, PNG, WEBP and GIF) and the maximum size of each file are indicated in the editor.

5.2. What the Service does not currently include. As of the date of this version, the Service does not store video or audio files (videos can be added as external links), does not allow Visitors to post messages or memories on the Page and does not include automated photo or text editing features. If we add any of these features in the future, we will explain how it works before you can use it; features that involve sending your Content to third parties will be optional and will be described in the Privacy Notice.

5.3. How a Page is obtained through a Funeral Home.

  1. You contract the Service with a partner Funeral Home and pay it directly (section 15).
  2. The Funeral Home registers the Page request in the Service with your name, telephone number and email address, and with the name and dates of birth and death of the Deceased Person. By doing so, the Funeral Home confirms that it has informed you and that it has your authorization to share that data with Cempa.
  3. The Funeral Home staff prepare the Page with the information and materials you provide to them. During this stage the Page is not visible to the public.
  4. You receive an email with a link to the Page. If you do not yet have an Account, you create it from that link (section 4.2).
  5. You have 14 calendar days to review the Page and either accept it or request changes. If you do neither within that period, the Page returns to the Funeral Home, which may send it to you again.
  6. Upon accepting the Page, you become its Holder and can edit it and decide whether it is public or private.

5.4. Public or private Page. The Page Holder decides its visibility and may change it at any time from their Account:

  • Public: anyone who has the link or scans the QR code can view it; it appears in the search on the Cempa website under the name of the Deceased Person and, over time, may appear in internet search engines.
  • Private: it does not appear in the Cempa search and cannot be viewed by the public; only the persons indicated in section 7 have access.

Please bear in mind that anything published on a public Page may be viewed, copied or photographed by any Visitor, and Cempa cannot prevent third parties from doing so outside the Service. In addition, photo files may contain metadata, such as the date, device or place where they were taken, which is stored and may be downloaded together with the photo; we recommend removing it before uploading.

6. What it means for the Page to be “permanent”

6.1. When Cempa says that a Page is permanent, it means exactly the following:

  1. One-time payment. There are no recurring fees, renewals or subscriptions to maintain the Page. Cempa will not charge you any amount to keep it published.
  2. No expiration date. The Page remains available for as long as Cempa provides the Service. It is not taken down due to the passage of time or Account inactivity.
  3. Independent of the Funeral Home. The Page is not taken down because of debts owed by the Funeral Home to Cempa, the termination of the relationship between them or the Funeral Home ceasing to operate.
  4. Reasons why a Page may stop being displayed. Only the following: (a) your decision, by cancelling the Service or making the Page private; (b) a resolution or order of a competent authority; (c) the Content notice procedure in section 13; (d) a serious breach of these Terms, in accordance with section 14, or (e) Cempa being unable to continue operating, in accordance with section 6.2.

6.2. If Cempa were unable to continue providing the Service. “Permanent” is not a guarantee of unlimited duration: the availability of the Page depends on Cempa continuing to operate. This section does not authorize Cempa to terminate the Service at its own discretion.

  • If Cempa were unable to continue providing the Service (for example, due to commercial insolvency proceedings (concurso mercantil), insolvency or an order of an authority), it will notify you by email and on the website at least 90 calendar days in advance. Before that period ends, it will send to your Account email a digital copy, or a link to download it, of the texts and photographs of your Pages, and you may also request it at any time during that period. Cempa will not charge you anything for this. You retain the rights granted to you by the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor), including a price reduction (bonificación) or compensation for the service not provided.
  • If the operation of the Service is transferred to another company (for example, by merger, spin-off (escisión) or assignment), the receiving company will continue to provide the same Service under the same conditions of these Terms. We will notify you by email at least 90 calendar days in advance, indicating which company will continue the Service. Before the transfer date, you may object to it in accordance with the Privacy Notice. If you object, your data will not be transferred and will be deleted in accordance with the Privacy Notice, the Service will be cancelled without penalty and we will provide you with a copy of your Content.

6.3. Your personal archive. Cempa takes reasonable measures to preserve the Content, but no system is free from failures. We recommend that you keep the originals of your photographs and texts: the Service does not replace your family archive.

7. Page Holder and management

7.1. Before delivery. While the Funeral Home is preparing the Page, its authorized staff may edit it. The Page is not visible to the public at this stage.

7.2. After delivery. From the moment you accept the Page, you are its Holder. Only the Page Holder can edit it, decide whether it is public or private and request its cancellation. Each Page has only one Holder at a time.

7.3. Other persons with access. In addition to the Holder, the following persons have access to the Page, even if it is private:

  • the administrators of the Account of the Funeral Home that requested the Page, who may view it at any stage, including after you accept it and when it is private, including the Content you add; they cannot edit it after you accept it. This access continues for as long as the Funeral Home’s Account is active in the Service, and
  • authorized Cempa staff, to provide support, handle notices and complaints, maintain the security of the Service and comply with legal obligations. Cempa staff only modify or hide Content when you request it or when required by law or by these Terms.

7.4. Good-faith management. The Page Holder manages the Page on behalf of the family and declares that they do so in good faith and with respect for the memory of the Deceased Person.

7.5. Transfer of management.

  • At the Holder’s request. The Holder may request, from their Account email to support@cempa.app, that management be transferred to another person of legal age, stating that person’s name and email address. The new person must create their Account and accept these Terms.
  • If the Holder dies, becomes incapacitated or cannot be located. An Immediate Family Member of the Deceased Person may request the transfer by submitting their official identification, the document evidencing their family relationship with the Deceased Person and, where applicable, the document evidencing the Holder’s situation (for example, the death certificate). The Holder is considered unable to be located when they do not respond, within a period of 30 calendar days, to two emails sent to their Account at least 15 calendar days apart and, if we have their telephone number, to a call.
  • Order of preference. If several family members request it, preference goes to the spouse or common-law partner; then to the daughters and sons; then to the mother and father, and then to the sisters and brothers. If the requesters are of the same degree, the written agreement of the other family members of that degree whom we have identified is required; without it, section 7.6 applies.
  • Notice to the Holder. Unless the Holder’s death is evidenced, before transferring management we will notify the Holder at their email address and wait 10 business days in case they wish to object.
  • The data and documents provided to us for this procedure are processed in accordance with the Privacy Notice.

7.6. Disagreements between family members. Cempa does not decide which family member has a better right over the memory of the Deceased Person. If an Immediate Family Member submits to us a documented objection to the content or the publication of the Page:

  1. We will inform the Page Holder and give them 5 business days to respond, unless there is an immediate risk to the safety or integrity of any person.
  2. After that period, if the parties do not reach an agreement, we may set the Page to private, without deleting its Content, for a maximum of 90 calendar days.
  3. At the end of that period, the Page will return to the visibility it had, unless before then we receive evidence that proceedings have been initiated before a competent authority. In any case, we will abide by the written agreement of the parties or the resolution of the authority.

8. Information about the Deceased Person

8.1. Mexican personal data protection legislation does not expressly regulate information about deceased persons. Regardless of this, Cempa undertakes that the information about the Deceased Person added to the Page:

  • will be treated confidentially and with the same security measures that we apply to personal data;
  • will be used solely to provide the Service;
  • will not be sold or used for advertising, and
  • will not be shared with third parties, except for what the Holder decides to publish on a public Page and except with the Funeral Home that requested the Page (section 7.3), with the providers that operate the Service on Cempa’s behalf under a duty of confidentiality, or at the request of a competent authority.

8.2. The Page Holder decides on that information: they may correct it, delete it, make the Page private or cancel it.

8.3. The personal data of living persons (Users, family members, Funeral Home staff and Visitors) are processed in accordance with the Privacy Notice.

9. Content published on Pages

9.1. Who is responsible for the Content. Each person is responsible for the Content they add to a Page.

9.2. Representations of the person uploading Content. By adding Content to a Page, you represent that:

  1. you are the author of the photographs and texts or have authorization from whoever holds the rights to them, including professional photographers;
  2. the living persons who appear or are identified in the Content have consented to its publication and, in the case of minors, that consent was given by the person who exercises parental authority (patria potestad) or guardianship over them;
  3. you have the agreement of the close family to publish the image and story of the Deceased Person, and
  4. to the best of your knowledge, the information is true.

9.3. Prohibited Content. It is not permitted to add to a Page any Content that:

  • is unlawful or promotes unlawful activities;
  • infringes copyrights, trademarks or other intellectual property rights;
  • harms the honor, private life or personal image of any person;
  • discriminates or incites hatred or violence;
  • is sexually explicit or affects the dignity of minors;
  • discloses sensitive personal data of living persons, such as their health status, without their consent, or contact or financial data of third parties, or
  • contains advertising, mass messages or links to malicious websites.

9.4. Content prepared by the Funeral Home. When Funeral Home staff write the biography or prepare other materials for the Page, the Funeral Home makes, with respect to that Content, the same representations as in section 9.2 and authorizes the Page Holder to use and modify it within the Page.

9.5. Review of Content. Cempa does not review Content before it is published, but it handles notices under section 13 and may act in accordance with section 14. Nothing in this section shifts to you any liability that Cempa bears under the law for the provision of the Service.

10. License you grant to Cempa over the Content

10.1. The Content remains yours. You retain whatever rights you hold over the Content. Cempa does not acquire any right over it other than the license described in this section.

10.2. Scope. As part of the contracted Service and without additional payments between you and Cempa, you grant Cempa a non-exclusive license, solely to the extent necessary to provide the Service to you, to:

  • store the Content and make the technical copies necessary to keep and transmit it;
  • adapt its format, for example, crop a photograph according to your instructions, resize it, compress it or convert its format;
  • display the Content on the Page according to the visibility you choose, and
  • generate the QR code and the preview that appears when the Page link is shared.

Cempa may only allow the use of the Content by the providers that operate the Service on its behalf and for that same purpose.

10.3. Purpose limitation. Cempa will not use the Content in advertising, demonstrations, social media or commercial materials, nor will it sell or assign it to third parties, unless you authorize it expressly, in advance and separately.

10.4. Term and territory. The license lasts as long as the Content remains in the Service and ends when you delete it or when the Page is cancelled, except during the recovery period and the final deletion period in section 16.2. It covers any place from which the Page is accessed over the internet.

10.5. Moral rights. The license does not affect the authors’ moral rights. Cempa will not alter the meaning of the Content and will keep the credits and captions you include.

11. Cempa’s intellectual property

The software, website design, templates and decorative elements that Cempa makes available to you (such as candles and ornaments), as well as the CEMPA™ trademark, trademark application pending before the IMPI, belong to Cempa or to those who have licensed them to it. You may use them only within your Pages and while you use the Service. It is not permitted to copy, modify or use them outside the Service without written authorization.

12. Visitors

12.1. Visitors may view public Pages and light virtual candles.

12.2. When viewing a Page, Visitors must respect the memory of the Deceased Person and their family, and must not copy or republish the Content for commercial purposes or without the authorization of whoever holds the rights to it, nor extract it by automated means.

12.3. If in the future the Service allows Visitors to post messages or memories, that feature will be enabled only together with the notice procedure in section 13; whoever posts a message will be responsible for it in accordance with section 9, and the Page Holder may hide it.

13. Content notices and takedown

13.1. Who may submit a notice. Any person, whether or not a Visitor, who considers that the Content of a Page infringes their copyright, harms their honor, private life or personal image, or is unlawful for another reason. Living persons who appear on a Page may also exercise their rights over their personal data in accordance with the Privacy Notice; the procedure in this section is the fastest way to remove the Content from public view.

13.2. How to submit it. Through the “Report content” option on the Page, when available, or by email to support@cempa.app. The notice must include:

  1. the name of the person submitting it and, if acting on behalf of another person, that person’s name;
  2. an email address and, if available, an alternative email address, as well as a postal address;
  3. the link to the Page and identification of the Content concerned (for example, which photograph or which text block);
  4. a brief description of the facts and of the right considered to be affected, and
  5. a statement, under oath to tell the truth (bajo protesta de decir verdad), that the information is correct and that the person is acting in good faith; in copyright matters, additionally, that they are the rights holder or are authorized by the rights holder, and that they are aware that providing false information may be penalized under the Federal Copyright Law (Ley Federal del Derecho de Autor).

We do not require registration certificates or titles to process a notice.

13.3. What Cempa does.

  1. We will confirm receipt of the notice no later than the following business day.
  2. If the notice is complete, no later than two business days after receiving it we will temporarily suspend the public visibility of the Page. The Service currently does not allow individual items to be hidden; when it does, we will hide only the Content identified. The Content is not deleted while the procedure is ongoing.
  3. No later than the following business day, we will inform the Page Holder of the reason, the content of the notice and how to respond. During the suspension, the Holder may continue to view and edit the Page.
  4. If the Holder removes or modifies the identified Content, we will restore visibility no later than the following business day and inform the person who submitted the notice.

13.4. Holder’s response (counter-notice). The Page Holder may respond to the notice. The response must include their name, an email address and a postal address; the documents evidencing that they hold the necessary rights or authorization (for example, a contract or a license) or, instead, a statement under oath to tell the truth that the use is permitted by law or that the Content is in the public domain, and a statement that they are aware that providing false information may be penalized. We will immediately inform the person who submitted the notice and send them a copy of the response. We will restore visibility between 10 and 15 business days after receiving the response, unless, within 15 business days after we inform them, the person who submitted the notice evidences that they have initiated judicial or administrative proceedings, a criminal complaint or an alternative dispute resolution mechanism.

13.5. Notices not related to copyright. Notices concerning honor, private life or personal image are processed under the same procedure. If, from the information received, it is evident that the notice is unfounded, we will restore visibility without waiting for the periods in section 13.4. In all other cases, the Page is restored if, within 15 business days after we inform the person who submitted the notice of the Holder’s response, we receive no evidence that any of the proceedings mentioned in section 13.4 has been initiated.

13.6. Repeat infringement. A notice is considered confirmed when Cempa has assessed it on its merits and concluded that the Content infringed rights, or when an authority has so ruled. Notices reversed by a response under section 13.4 and objections between family members under section 7.6 do not count. If, within a period of 12 months, three notices are confirmed regarding Content added from the same Account, we may suspend that Account’s access for up to 6 months, in accordance with section 14. Suspension of the Account does not affect the visibility of the Page, except as provided in section 13.3, and during the suspension management may be transferred to another family member in accordance with section 7.5.

13.7. Orders of authorities. Orders of competent authorities are complied with on the terms established by the order itself and by law.

14. Cempa’s measures in the event of breach

14.1. Where there is a breach of these Terms, a risk to the security of the Service, fraud or an order of an authority, Cempa may temporarily suspend the public visibility of a Page, suspend an Account or, as a last resort, close it.

14.2. Except in the cases in section 14.3, before applying a measure we will inform you of the reason and give you 5 business days to respond. We will always apply the least restrictive measure available that resolves the problem.

14.3. We will only act without prior notice when ordered by an authority, when the Content is clearly unlawful (for example, sexual content involving minors, or content inciting violence) or when there is an immediate risk to the security of the Service or of other persons. In those cases we will inform you of the measure and its reason immediately afterwards.

14.4. While a measure is under review, we do not delete the Content. You may request a copy of your Content, except for any Content that is unlawful.

14.5. Taking down a Page for breach is the last resort: it is only applied after having offered to remove only the infringing Content or to transfer management to another family member in accordance with section 7.5, and always with delivery of a copy in accordance with section 14.4. Closing a Holder’s Account does not, by itself, entail taking down their Pages.

15. Price, payment and tax receipts

15.1. Funeral home channel. The price of the Page is set and collected by the Funeral Home, at its premises and through the payment methods it offers. The Funeral Home is the one that issues you the tax receipt (CFDI) for that payment and, where applicable, corrects it. Cempa does not receive payments from families in this channel and will not charge you any additional fee for the Page you contracted or for maintaining it.

15.2. Clarifications about charges. If you have questions or disagreements about what the Funeral Home charged you, you may contact the Funeral Home, Cempa in accordance with section 20, or directly the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO).

15.3. Direct online sales. As of the date of this version, Cempa does not sell Pages online or receive payments on its website. If it does so in the future, before payment you will be shown the total price in Mexican pesos including VAT (IVA), what the purchase includes, the payment methods, the cancellation and refund conditions and how to obtain your CFDI. Those purchase conditions will be incorporated into these Terms in accordance with section 21.

16. Cancellation, revocation, refunds and closure of the Account

16.1. Immediate cancellation. The Page Holder may cancel the Service at any time, without penalty, without giving reasons and without needing to go to the Funeral Home. The cancellation takes effect at the moment we receive the request.

  • How to request it. Through the cancellation option in your Account, when available, or by sending an email to support@cempa.app from your Account email, with the subject “Cancelación” (Cancellation) and identifying the Page. You may also call [TELÉFONO] or deliver a written request at [DOMICILIO].
  • To make the Page stop being visible instantly. At any time, before or after requesting cancellation, you can switch the Page to private from your Account.
  • What we do. We will remove the Page from view and close access to it without delay, no later than 24 hours after we receive your request. We will email you a cancellation certificate stating the date and time of receipt, which we will also communicate to the Funeral Home.

16.2. What happens to the Page upon cancellation.

  1. From the moment we deactivate it, the Page is no longer visible to the public or to the Funeral Home, and the QR code no longer opens it.
  2. During the following 30 calendar days, you may ask us to restore it or to send you a digital copy of your texts and photographs.
  3. Once that period ends, we will permanently delete the Page’s Content within the following 30 calendar days.
  4. We will keep only the information that the law requires us to keep, such as the record of acceptance in section 3, which is kept for at least ten years, and the log of Content notices, for the period and purpose established by law.

16.3. Revocation within 5 business days. Within the five business days following the day on which you accept the Page (section 5.3), you may revoke your consent without any liability and without giving reasons. To do so, use any of the means in section 16.1 with the subject “Revocación” (Revocation). The Page is cancelled in accordance with sections 16.1 and 16.2, and we will send you a revocation certificate stating the date of receipt, which we will also communicate to the Funeral Home.

16.4. Refunds. In the funeral home channel, Cempa does not receive the payment for the Page: the Funeral Home does. Therefore, any refund, whether for revocation or cancellation, is requested from the Funeral Home and is governed by the conditions you agreed with it and by the rights the Federal Consumer Protection Law grants you with respect to it. The Funeral Home is responsible for issuing the tax receipt corresponding to the refund. Cempa’s obligation is to cancel the Page in accordance with section 16.1 and to provide you with the cancellation or revocation certificate so that you can present it to the Funeral Home; at your request, we will also provide you with the information we hold on the dates of delivery, acceptance and cancellation of the Page. If the Funeral Home does not address your request, you may go to PROFECO. Nothing in the foregoing limits the rights the Federal Consumer Protection Law grants you with respect to the Funeral Home or to Cempa, including a price reduction (bonificación) or compensation when Cempa’s Service is not provided or is provided deficiently for reasons attributable to Cempa.

16.5. Closure of the Account.

  1. You may request the closure of your Account at any time through the corresponding option, when available, or by email to support@cempa.app from your Account email.
  2. If you are the Holder of any Page, we will ask you to indicate whether you wish to cancel it (section 16.1) or transfer its management (section 7.5).
  3. The closure takes effect from the moment we receive your request or, if you are the Holder of any Page, your answer. We will close access to the Account no later than 24 hours thereafter and send you a confirmation by email.
  4. During the 30 calendar days following closure, you may ask us to restore the Account. Once that period ends, we will permanently delete your data within the following 30 calendar days, except for the information that the law requires us to keep (section 16.2, item 4).
  5. If, instead of closing the Account, you request the cancellation of your personal data in accordance with the Privacy Notice, the procedure and time limits of that Notice apply, without the recovery period.
  6. The Accounts of Funeral Home staff are deactivated at the request of the Funeral Home or of Cempa, without affecting the Pages already delivered to families.

17. Availability of the Service and liability

17.1. Cempa strives to keep the Service running continuously. It may be interrupted for maintenance, technical failures, failures of hosting or internet connectivity providers, or acts of God or force majeure. We will endeavor to give notice by email of scheduled maintenance involving interruptions and to carry it out during off-peak hours.

17.2. Cempa is liable for the provision of the Service in accordance with applicable legislation, including the Federal Consumer Protection Law. No provision of these Terms excludes or limits that liability. If an interruption or failure attributable to Cempa affects your Page, you may file a complaint with us in accordance with section 20 and request the corresponding price reduction (bonificación) or compensation under articles 92 Bis and 92 Ter of that law.

17.3. Cempa does not control the content or availability of the third-party websites to which external links added to a Page lead, such as video platforms. Maps of the burial site are displayed using information from a third-party mapping service.

18. Security

The Service protects access to Accounts with passwords that are stored protected by a function that does not allow them to be recovered, confirms the email address upon registration and limits access to each Page according to each person’s role (section 7). The security measures for personal data and how we will notify you of a breach are described in the Privacy Notice. To protect your Account, use a password that you do not use for other services and do not share it with anyone.

19. Communications

19.1. Cempa communicates with you by email at your Account address and through notices within the Service. By email we send you, among other things, the invitation to review your Page, the cancellation or revocation certificates, notices about Content and changes to these Terms.

19.2. We will only send you promotional emails if you authorize it separately; each one will include an unsubscribe link.

19.3. For general inquiries you may also write to us via WhatsApp at [TELÉFONO]. Requests for cancellation, revocation or closure of the Account, notices about Content and complaints are submitted through the means in sections 13, 16 and 20, which allow us to verify your identity and keep a record.

20. Clarifications and complaints

20.1. Free channels. Email support@cempa.app, telephone [TELÉFONO] or a written submission delivered at [DOMICILIO]. For general inquiries we also respond via WhatsApp at the same number.

20.2. Service hours. Monday to Friday, from 9:00 a.m. to 6:00 p.m. (Central Mexico time), except official public holidays. Emails are received at any time; the time limits in this section are counted from the business day following receipt.

20.3. What to include. Your name, a contact detail, the link to the Page, if a Page is concerned, and a description of the situation. You may attach any documents you consider useful.

20.4. Time limits. We will send you an acknowledgment with a reference number (folio) no later than two business days after receiving your complaint and a reasoned response no later than ten business days thereafter. If we need more information, we will ask you for it only once, and the time limit will resume when we receive it.

20.5. Optional procedure. This procedure is voluntary: it is not a prerequisite for going to PROFECO or to the courts.

20.6. PROFECO. The Federal Consumer Protection Agency (Procuraduría Federal del Consumidor) is the competent authority to handle, through administrative channels, consumer complaints in Mexico. You can contact it through the Consumer Hotline (Teléfono del Consumidor), 55 5568 8722 (Mexico City and metropolitan area) and 800 468 8722 (rest of the country), or at https://www.gob.mx/profeco.

21. Changes to these Terms

21.1. No unilateral changes. Cempa cannot unilaterally modify these Terms with respect to you. Each version has a number and a date; we keep previous versions and will send them to you upon request.

21.2. Changes that affect your rights or obligations. We will notify you by email and within the Service at least 15 calendar days in advance, explaining what changes. The new version will only apply to you once you accept it. When you sign in after the effective date, you will see the new version and a screen to accept it.

21.3. If you do not accept the new version. Your published Page remains unchanged and subject to the version you accepted; it is not taken down and no charge is incurred for not accepting. Without accepting the new version, you may continue to view your Page, switch it to private or public, request a copy of your Content and cancel the Service without penalty in accordance with section 16. To continue editing the Page from your Account you will be asked to accept the new version; if you do not wish to do so, you may request by email to support@cempa.app the changes you need, which we will make in accordance with the version you accepted no later than 5 business days after receiving your request.

21.4. Changes that do not affect your rights. The correction of typographical errors, the update of Cempa’s contact details or address and wording clarifications that do not change the meaning of a provision are published with a new date and communicated to you, without requiring new acceptance. If you consider that one of those changes does affect you, you may object in writing and the previous version will continue to apply to you.

21.5. No change applies retroactively.

21.6. Funeral Home staff. For Funeral Home staff, accepting the new version is necessary to continue using their Funeral Home Account. This does not affect the families’ Pages.

22. Governing law and courts

22.1. These Terms are governed by applicable Mexican law, in particular the Federal Consumer Protection Law, the Commercial Code, the Federal Civil Code and, with respect to the Content, the Federal Copyright Law.

22.2. Any dispute will be resolved before the competent courts of the United Mexican States; in no case before foreign courts. This provision does not prevent you from going to PROFECO or to the courts of your place of residence where the law allows.

22.3. Nothing in these Terms implies a waiver of the rights granted to you by the Federal Consumer Protection Law, nor does it modify the statutes of limitations established by law.

23. Final provisions

23.1. Severability. If any provision of these Terms is declared invalid, the remaining provisions remain valid, and the invalid provision is replaced by what the law establishes.

23.2. Interpretation. In case of doubt as to the meaning of a provision, the interpretation most favorable to you as a consumer will apply.

23.3. Language. These Terms are entered into in Spanish.
